Banyak perusahaan yang kurang memahami atau bahkan tidak tahu bahwa ada batasan hukum mengenai durasi maksimal kontrak, sehingga berisiko menimbulkan pelanggaran ketenagakerjaan. Salah satu batasan penting yang harus dipenuhi adalah <strong>batas maksimal kontrak kerja<\/strong>.<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Batas Maksimal Kontrak Kerja Adalah 5 Tahun<\/strong><\/h2>\n\n\n\n<p>Perusahaan yang mempekerjakan karyawan dengan status kontrak atau PKWT, <strong>tidak boleh memperpanjang kontrak lebih dari 5 tahun<\/strong>, sesuai dengan <strong>Pasal 6 dan Pasal 8 ayat (1) Peraturan Pemerintah Nomor 35 Tahun 2021 <\/strong>tentang Perjanjian Kerja Waktu Tertentu, Alih Daya, Waktu Kerja Dan Waktu Istirahat, dan Pemutusan Hubungan Kerja (\u201c<strong>PP35<\/strong>\u201d). Total keseluruhan masa kontrak (kontrak pertama + perpanjangan-perpanjangan) tidak boleh melebihi 5 tahun. Perusahaan yang tetap mempekerjakan karyawan kontrak melebihi batas tersebut berpotensi dianggap melanggar aturan PKWT.<\/p>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Apa yang Sebaiknya Diperhatikan Perusahaan dan Karyawan?<\/strong><\/h2>\n\n\n\n<p><strong>Untuk Perusahaan:<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Pastikan perhitungan kontrak dan perpanjangan dilakukan secara tepat.<\/li>\n\n\n\n<li>Gunakan PKWT hanya untuk pekerjaan yang benar-benar memenuhi syarat (kondisional, bukan pekerjaan inti yang sifatnya terus-menerus).<\/li>\n\n\n\n<li>Dokumentasikan setiap perjanjian secara tertulis.<\/li>\n<\/ol>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<p><strong>Untuk Karyawan:<\/strong><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>Tinjau kembali dokumen PKWT Anda.<\/li>\n\n\n\n<li>Pastikan durasi total kontrak Anda tidak melampaui 5 tahun.<\/li>\n\n\n\n<li>Bila merasa ada pelanggaran, Anda dapat berkonsultasi dengan Dinas Ketenagakerjaan atau meminta pendampingan hukum.<\/li>\n<\/ol>\n\n\n\n<div style=\"height:20px\" aria-hidden=\"true\" class=\"wp-block-spacer\"><\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Kesimpulan<\/strong><\/h2>\n\n\n\n<p>Batas maksimal masa kontrak adalah <strong>5 tahun<\/strong> dan tidak boleh dilampaui dengan alasan apa pun.
